As of August 1st of 2016, in order to improve their effectiveness as a deterrent, the EPA has revised over 66 statutory penalties to account for what the Agency refers to as a “catch-up adjustment” related to inflation.
These adjustments vary based on violation, but affected sources should plan on an across-the-board increase. For example, daily maximums for violating required implementation plans or permits for major emitting facilities under the Clean Air Act (most of our Power Plant and Cement Plant Clients fall under this) have increased from $37,500 to over $93,000 per-day per violation.
The costs associated with noncompliance have never been greater.
